These SMS Terms & Conditions (“SMS Terms”) govern text messages sent by Patern AL Investments, LLC, doing business as Patern Investments (“Patern Investments,” “we,” “us,” or “our”), to individuals who opt in or initiate a text conversation with us. By opting in to or using our text-messaging service, you agree to these SMS Terms, our Privacy Policy, and the applicable consent disclosure presented when you opted in.
1. Program Description and Message Types
Patern Investments Customer Communications is a low-volume conversational and informational SMS/MMS program. Depending on your request or relationship with us, messages may include:
- Responses to questions or website inquiries.
- Property-specific communications and requested updates.
- Appointment scheduling, confirmations, reminders, or changes.
- Requests for information or documents related to your inquiry.
- Service, transaction, rental, tenant, seller, buyer, vendor, or customer follow-up that you requested or reasonably expect within the disclosed purpose.
This program does not include marketing or promotional text messages unless you provide separate, express written consent through a separately presented marketing opt-in and that campaign has been appropriately registered and approved.
2. How You Opt In
You may opt in by checking the separate SMS consent box on our website form, by texting us first and requesting a response, by texting an advertised opt-in keyword when available, or through another affirmative method that clearly identifies the message types and terms. Website SMS checkboxes are optional and are not preselected. Submitting a general website form without checking the SMS box does not enroll you in recurring texts.
By opting in, you authorize Patern Investments to send the disclosed messages to the mobile number you provide, including through automated technology when used. Your consent applies only to Patern Investments and the disclosed program; it is not transferable. Consent is not a condition of purchasing or selling property, applying for or renting housing, entering a transaction, or receiving services.
3. Message Frequency
Message frequency varies based on your inquiry, appointments, activity, and relationship with us. Because this is primarily a conversational and informational program, you may receive multiple messages during an active conversation and no messages when no communication is needed.
4. Message and Data Rates
Patern Investments does not charge a separate fee for the text-messaging program, but message and data rates may apply under your wireless plan. Contact your wireless carrier for information about your plan.
5. Opting Out
You may opt out at any time by replying STOP to any Patern Investments text. We also honor reasonable opt-out requests such as CANCEL, END, QUIT, UNSUBSCRIBE, or a clear request such as “please stop texting me.” We may send one final, non-promotional text confirming the opt-out. After that confirmation, we will send no further messages from that program or number unless you provide new consent. You may also request an opt-out by contacting us by telephone or email.
6. Help and Customer Care
Reply HELP for help. You may also call (888) 350-3388 or email patricia@patern.org. If you believe a message was sent in error, contact us and include the mobile number that received the message.
7. Rejoining the Program
After opting out, you may rejoin only by providing new consent, such as by replying START when supported, checking the website SMS box again, or using another affirmative opt-in method we make available.
8. Mobile Number Ownership and Changes
You represent that you are the subscriber or customary user of the mobile number you provide and are authorized to consent to texts at that number. If you change, deactivate, or reassign your number, notify us promptly and opt out before relinquishing it. We may use reasonable measures to identify and suppress deactivated or reassigned numbers.
9. Delivery and Carrier Disclaimer
Text delivery is subject to network availability and is not guaranteed. Messages may be delayed or not delivered. Wireless carriers are not liable for delayed or undelivered messages. Supported carriers and service availability may change without notice.
10. Privacy
Our Privacy Policy explains how we handle information. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.
11. No Emergency or Time-Critical Use
SMS is not an emergency service and may not be monitored continuously. Do not use text messaging for emergencies, safety threats, urgent legal deadlines, or time-sensitive payment or closing instructions. Call 911 for emergencies and use independently verified contact information for sensitive transaction instructions.
12. Eligibility
You must be at least 18 years old and authorized to use the mobile number to enroll in this program.
13. Changes or Termination
We may modify or discontinue the program or these SMS Terms. We will post changes on this page and provide any additional notice required by law. We may suspend messaging for security, compliance, carrier, or operational reasons.
